Getting your disclosure.

What you are owed
  • All relevant, non-privileged material the Crown holds, helpful to you or not.
  • Since R v Stinchcombe, 1991, it is a legal duty, not a favour.
What is in it
  • Police reports and officer notes, witness statements, the synopsis.
  • 911 audio, cruiser and body-camera video, photos, and any technical or expert reports.
If something is missing
  • Write to the Crown. List each item by name. Date it. Keep a copy.
  • A precise written request creates a record a judge can act on.
Remember
  • Read the whole package, more than once, with the charges beside it. The gaps are where the defence is.
